These Terms and Conditions ("Terms") apply to your use of the ShresMove website and to the moving and delivery services provided by ShresMove ("ShresMove", "we", "us" or "our"). Please read them carefully. By using our website or booking our services, you agree to these Terms.
If you book a move, your written estimate or moving agreement sets out the details of your job, such as price, dates and coverage. If it conflicts with these Terms, the written estimate or moving agreement applies. Nothing in these Terms limits any rights you have under consumer protection law in your province, including Ontario's Consumer Protection Act, 2002.
Our services
ShresMove provides residential and commercial moving services, including local and long-distance moves, packing, loading, transport, unloading and related services, and parcel delivery services for businesses. The services included in your job are those listed in your written estimate or moving agreement.
Service availability depends on the route, date and our capacity, and is confirmed only when we accept your booking.
Quotes and estimates
- Sending a quote request through our website is not a booking and does not commit you or us to anything.
- Prices on our website or given over the phone are general information until confirmed in a written estimate.
- Your estimate is based on the information you give us, such as the size of your home, the items to be moved, access at both addresses and any extra services. If the actual job differs (for example, more items, stairs or long carries we were not told about, or added services), the price may change. We will explain any change and ask for your agreement before doing the extra work.
- If we give you a written estimate, we will not charge more than 10% above it without your consent, as Ontario's Consumer Protection Act, 2002 requires.
- Unless your estimate says otherwise, it is valid for 30 days. All prices are in Canadian dollars, and applicable taxes (GST/HST/PST) are added.
Booking and payment
- Your booking is confirmed when we send you a written confirmation. Any deposit needed to hold your date is set out in your estimate or moving agreement.
- Payment terms, accepted payment methods and when payment is due are set out in your estimate or moving agreement.
- We may hold back delivery of your belongings for unpaid charges only where the law allows. We will never charge you for anything you did not agree to.
Changes and cancellations
- Please tell us as early as possible if you need to change your moving date, addresses or the items to be moved. We will do our best to accommodate changes, subject to availability, and will tell you of any change in price before it applies.
- Cancellation and rescheduling terms, including any fees and how a deposit is refunded, are set out in your estimate or moving agreement. Any cancellation fee will be reasonable and will reflect our actual costs and losses.
- If we must cancel or reschedule because of events beyond our control, such as severe weather, road closures, accidents, labour disruptions or emergencies, we will tell you as soon as possible and offer a new date or a full refund of amounts paid for services not provided.
- If your agreement was made away from our business premises or online, you may have additional cancellation rights under your province's consumer protection law.
Your responsibilities
To help your move go smoothly and safely, you agree to:
- give us accurate and complete information about your move, including items, access, stairs, elevators and distances to the truck;
- arrange any elevator bookings, loading-dock times, parking permits and building permissions at both addresses;
- have your belongings packed and ready on moving day, unless packing is part of your booking;
- empty, clean and disconnect appliances, and drain fuel from equipment, before we arrive;
- be present, or have an adult you authorise present, at pickup and delivery to direct the crew and check the inventory;
- keep cash, jewellery, important documents, medications, keys and other valuables or irreplaceable items with you; and
- make sure you have the right to move the items you ask us to move.
Items we cannot move
For safety and legal reasons, we cannot transport:
- hazardous or flammable materials, such as propane tanks, gasoline, oil, paint, solvents, cleaning chemicals, aerosols, fireworks, ammunition and explosives;
- firearms, unless we have agreed to it in advance in writing and the law allows it;
- perishable food, live plants on long-distance moves, and any animals; and
- illegal items or goods.
We may refuse to move, or may stop moving, any item that we reasonably believe is unsafe, illegal or not described when you booked.
Moving day
- Arrival times are estimates. We will keep you informed of delays caused by traffic, weather or earlier jobs.
- Our crew may decline to move an item if doing so would put people, property or the item at serious risk, for example where it will not fit through a doorway or stairwell without damage.
- Waiting time caused by access problems, unavailable elevators or items not ready to move may be charged as set out in your estimate or moving agreement.
- Please check your belongings and the inventory before the crew leaves and note any visible damage or missing items on the paperwork.
Protection for your belongings
- We take reasonable care of your belongings while they are in our possession. We are responsible for loss or damage caused by our negligence, subject to the coverage and limits in your estimate or moving agreement.
- The level of protection included in your price, and any optional extra coverage you can buy, are set out in your estimate or moving agreement. We recommend you also check what your home or tenant insurance covers during a move.
- Unless the law says otherwise, we are not responsible for: items you packed yourself, where the damage is not caused by our handling; the contents of drawers or furniture; the mechanical or electrical working of items; normal wear, or damage caused by the item's age or condition; items you kept with you; or loss or damage caused by events beyond our control.
Claims for loss or damage
- Tell us about any loss or damage as soon as possible, ideally on moving day, and note it on the inventory or delivery paperwork.
- Send your claim in writing to shreshtha@shresmove.ca, with a description of each item, photos of the damage, and proof of value where available, within the time set out in your estimate or moving agreement.
- Please keep damaged items and packaging until we have reviewed your claim. We may repair, replace or pay the value of an item, as set out in your coverage.
- We will acknowledge your claim promptly and aim to resolve it fairly and quickly.
Using our website
- Information on our website, including moving tips and service descriptions, is general information. It may change and is not a quote or professional advice.
- The website's content, design, logos and trademarks belong to ShresMove or its licensors. You may view and print pages for your own personal use, but you may not copy, sell or reuse them for any other purpose without our written permission.
- You agree not to misuse the website, including by sending false or automated quote requests, attempting to gain unauthorised access, interfering with its security or operation, or sending harmful code.
- Links to other websites are provided for convenience. We are not responsible for their content or practices.
- We try to keep the website available and accurate, but we do not promise it will always be available, error-free or up to date.
Limitation of liability
To the extent permitted by law, ShresMove is not liable for indirect or consequential losses, such as lost income, hotel or storage costs, or missed connections, arising from your use of our website or services, except where caused by our negligence or wilful misconduct. Our liability for loss of or damage to your belongings is as set out in "Protection for your belongings" and your estimate or moving agreement.
Nothing in these Terms excludes or limits any liability that cannot be excluded or limited by law, or any rights you have as a consumer.
Privacy
We handle your personal information as described in our Privacy Policy, which forms part of these Terms.
Governing law and disputes
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. If you live in another province, you also keep the protection of the mandatory consumer laws of your province.
If you have a concern, please contact us first; most issues can be resolved quickly. If we cannot resolve a dispute, it may be brought before the courts of Ontario or any other court that has jurisdiction under consumer protection law. Nothing in these Terms requires a consumer to go to arbitration or prevents you from bringing a claim in Small Claims Court.
General
- If any part of these Terms is found to be invalid or unenforceable, the rest of the Terms remain in effect.
- If we do not enforce a right under these Terms, we do not give up that right.
- These Terms, together with your written estimate or moving agreement and our Privacy Policy, are the whole agreement between you and us about our services.
Changes to these Terms
We may update these Terms from time to time. The "Last updated" date at the top shows when they last changed. Changes apply to future use of our website and to bookings made after the change; the Terms in effect when you booked apply to your move.
